Terms of Service

These terms are a plain-English agreement between you and Treetop Creative (“we”, “us”), a sole trader based in Australia. They apply every time you create an account, upload photos or use anything in the app. If you don't agree with them, please don't use the service.

1. What Treetop Creative does

Treetop Creative is a tool for photographers. You upload photos from a session (up to 250 per session), and we process them through Google Gemini via Lovable's AI gateway to select and rank the strongest frames. Depending on what you select, we then generate captions, reel concepts, story concepts, client emails, educational posts and engagement prompts.

The output is a creative suggestion, not a professional judgement. You should always review picks and copy before publishing or sending anything to a client.

2. Eligibility

You must be at least 18 years old to use Treetop Creative. This is a professional business tool and it is not designed for or directed at minors. By using the service you confirm you're 18 or over and that you have the authority to agree to these terms (including on behalf of your business, if you use it for work).

3. Your account

You sign in with an email address and password, or with Google. You're responsible for keeping your login details secure and for activity that happens under your account. Please tell us at bsquire61@gmail.com if you think someone else has access to it.

4. Your photos stay yours

You keep full ownership of every photo you upload. We don't claim any ownership of your images, and we don't use them to advertise the service, to train our own models, or for anything unrelated to your session.

You grant us only the narrow permission we need to run the service for you: to store your uploads, to send them to our AI processing provider so they can be analysed and ranked, to display them back to you, and to keep them in your session library so you can return to past sessions. That permission ends when you delete the session or your account.

5. Acceptable use

You agree not to:

  • upload photos you don't own or don't have the rights or permissions to use, including images of people who haven't consented to your use of them;
  • upload illegal content, sexual content involving minors, or content that is abusive, harassing or unlawful in Australia;
  • attempt to break, overload, scrape or reverse-engineer the service, or bypass usage limits, the free-tier cap or billing;
  • resell or sublicense access to the service without our written agreement;
  • use the service to produce content that misleads or deceives others.

If you breach these rules we may suspend or close your account. Where the breach is serious or unlawful, we may do so immediately and without a refund.

6. Subscription, billing and cancellation

  • Free tier. Every account gets 3 free curated sessions. After that, a subscription is required to run more sessions.
  • Price. Photo Curator Pro is $29 AUD per month, charged monthly in advance and renewing automatically until you cancel.
  • Payments. Payments are handled by Stripe. We never see or store your card number — Stripe does. Your card details are collected and held by Stripe under their own terms.
  • Cancelling. You can cancel any time, yourself, through the Stripe Customer Portal linked in the app. Your subscription then stops at the end of the billing period you've already paid for, and you keep access until then.
  • Refunds. We don't offer refunds for partial months or for unused sessions. Nothing here limits the rights you have under the Australian Consumer Law — if the service fails to meet a consumer guarantee, you may be entitled to a repair, replacement or refund, and we'll honour that.
  • Price changes. If we change the price we'll give you at least 30 days' notice by email before it applies to your next renewal, so you can cancel first if you'd rather not continue.

7. Availability

We work to keep the app fast and available, but it's provided on an “as is” basis. AI providers occasionally rate-limit, slow down or return imperfect results, and maintenance or third-party outages can interrupt service. We don't guarantee uninterrupted availability or that a given curation will match your taste.

8. Limitation of liability

To the extent permitted by law, Treetop Creative is not liable for indirect or consequential loss — including lost profits, lost clients, lost bookings, loss of reputation, or loss or corruption of data — arising from your use of the service. Where we are liable and the law allows us to limit that liability, our total liability is capped at the amount you paid us in the 12 months before the claim.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

You keep your own backups of your original photos. Treetop Creative is not a backup or archival service and should not be relied on as one.

9. Ending the agreement

You can stop using the service at any time and request that your account and data be deleted by emailing bsquire61@gmail.com. We may close an account that breaches these terms, or discontinue the service entirely — if we do discontinue it, we'll give reasonable notice by email so you can download anything you want to keep.

10. Changes to these terms

We may update these terms as the service changes or as the law requires. When we make a change that materially affects you, we'll update the “as of” date at the top of this page and notify you by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms.

11. Governing law and contact

These terms are governed by the laws of Australia, and you and we submit to the jurisdiction of the Australian courts.
